1. Agreement to Terms

These Terms of Use ("Terms") form a binding agreement between you and AI Films Studios LLC ("CineFold," "we," "us," or "our") governing your access to and use of cinefold.io and any related applications, features, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent that you meet this requirement.

3. Description of the Service

CineFold provides tools to generate images, video, music, and related creative content using third-party AI models (including but not limited to models made available via fal.ai, Anthropic, Google, OpenAI, xAI, and ByteDance). Generation requests are processed by these third-party providers; your prompts, uploaded reference images, and generated outputs may be transmitted to them to fulfill your request. Their own terms and acceptable-use policies also apply to content generated through their models.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at contact@cinefold.io if you suspect unauthorized use of your account.

5. Subscriptions, Credits & Billing

Certain features require a paid subscription or the purchase of credits, billed through our payment processor, Stripe. Subscriptions renew automatically at the then-current price until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Credits are consumed when you generate content and, except where required by law or expressly stated otherwise, are non-refundable and do not carry over indefinitely if your account is closed. We reserve the right to change subscription pricing and credit costs; material changes will be communicated in advance for existing subscribers where reasonably practicable.

6. Acceptable Use

You agree not to use the Service to generate, upload, or distribute content that:

• Depicts or sexualizes minors in any way, or otherwise violates child-safety laws;
• Is intended to harass, defame, threaten, or impersonate a real person without consent;
• Infringes another party's intellectual property, privacy, or publicity rights;
• Is unlawful, fraudulent, or promotes violence, self-harm, or illegal activity;
• Attempts to circumvent usage limits, security measures, or the acceptable-use policies of underlying AI providers.

We may suspend or terminate accounts that violate this policy, remove offending content, and where required by law, report certain content (including suspected child sexual abuse material) to the relevant authorities.

7. Ownership of Generated Content

Subject to your compliance with these Terms and payment of applicable fees, you own the outputs you generate through the Service, to the extent permitted by the terms of the underlying AI providers and applicable law regarding AI-generated works. We claim no ownership over your generated content. You grant us a limited license to store and display your content back to you within the Service, and — only where you opt in (e.g., a public showcase feature) — to display it to other users.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. AI-generated content may be inaccurate, unexpected, or unsuitable for a given purpose; you are responsible for reviewing outputs before relying on or distributing them.

9. Limitation of Liability

To the maximum extent permitted by law, CineFold and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service and close your account at any time via your account settings or by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, via email or an in-product notice) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
